North Brunswick, Somerset and Two Milltown Residents Are Charged with Drug and Paraphernalia Possession on the Garden State Parkway in Lacey Township

The scene was a prisoner apprehension causing bumper to bumper traffic on the Garden State Parkway in Lacey Township. But, the unexpected consequences for the driver and three passengers who were directed around the scene were drug possession and drug paraphernalia charges.  A New Jersey State Trooper pulled over the vehicle after smelling marijuana coming from their passing car.  Marijuana, ecstasy pills and paraphernalia were found in their vehicle.

Marijuana, Ecstasy and Other Controlled Drugs and Paraphernalia Possession?  The Penalties

Drivers who are stopped and found with drugs and drug paraphernalia are up against costly penalties with heavy fines, jail or prison time depending on the amount and drugs they are carrying and loss of driver licenses.

N.J.S.A. 2C:35-10 and Marijuana

New Jersey law states that individuals possessing more than 50 grams of marijuana, including any adulterants or dilutants, or more than five grams of hashish are guilty of a fourth degree crime and courts can impose a fine of up to $25,000.00 and prison sentence up to 18 months. Possession of 50 grams or less of marijuana, including any adulterants or dilutants, or five grams or less of hashish is a disorderly person offense.

N.J.S.A 2C:35-10 and Ecstasy or Other Controlled Substances or Drugs

In possession of Ecstasy?  If you're in New Jersey and caught possessing controlled dangerous substances or drugs producing the same pharmacological effect means the law can bring charges of a third degree crime and a fine of up to $35,000.00 can be impaired and you could go to prison for up to 5 years.

N.J.S.A. 2C:36-2  Possession of Drug Paraphernalia

In New Jersey, drug paraphernalia possession is a disorderly persons offense with penalties of up to a $1,00.00 fine, other costs and potential jail time. New Jersey's criminal statutes specifically state that it is ”…unlawful for any person to use, or to possess with intent to use, drug paraphernalia to plant, propagate, cultivate, grow, harvest, manufacture, compound, convert, produce, process, prepare, test, analyze, pack, repack, store, contain, conceal, ingest, inhale, or otherwise introduce into the human body a controlled dangerous substance, controlled substance analog or toxic chemical in violation of the provisions of chapter 35 of this title.”
