In New Jersey, when we hear the term ‘Restraining Order', we almost always imagine an abusive domestic partner, sexual offender or stalker. It is indeed true that New Jersey courts frequently issue Restraining Orders that legally restrict such dangerous people from contacting or communicating with their victims. There is one additional group of offenders who are also the subject of Restraining Orders. These are drug offenders who are issued a Drug Offender Restraining Orders (DORO) as a means to keep the offenders away from their previous place of operation. Unlike traditional restraining orders a DORO is meant to protect the offender rather than a victim.
Drug Offense Restraining Order (N.J.S.A. 2C:35-5.4 to 5.10)
In 1999 the New Jersey Supreme Court established the use of the Drug Offender Restraining Order (DORO). The main goal of DORO is to keep those with a drug related conviction from revisiting the area where their initial criminal activity took place. It was believed that by preventing those with a DORO from revisiting these areas it will allow the area the opportunity to improve. A DORO is put in place for those convicted or currently accused of drug possession or drug distribution by banning these offenders from locations where they conducted their past illegal drug activities.
Whatever category the Restraining Order falls under, it should not be taken lightly as it substantially restricts the person who has a DORO freedom to move about freely. Disobeying a Drug Offense Restraining Order has very serious consequences that can result in the revoking of a person's parole, or bail and can result in additional prison time. It is hard but not impossible to alter a Restraining Order that was issued. A New Jersey Superior Court Judge might entertain an application to vacate a Restraining Order only if they are fully convinced that the circumstances have changed and mitigating factors exist.
